Solo and small-firm practice rarely comes with a ready-made health plan. Three questions lawyers raise:

I bill by the matter, not the month.

Contingency wins, retainers, and slow collections can bunch income into a few months. Total what you expect for the full year, not one busy quarter.

My firm is me and a paralegal.

Group plans usually need at least one eligible employee who is not the owner or the owner's spouse. Until you meet that bar, a personal or family plan is the usual path.

Partners and associates are not the same.

A partner's draw and an associate's W-2 can open different options. Tell us how you are paid so we compare the right paths.

How law-practice income works

Fees, draws, and W-2 pay.

The Marketplace bases tax credits on your household income for the year you are covered.

  • Solo counsel often invoice by the matter or keep client retainers. Count money in the year it reaches you.
  • Small-firm partners may take draws that rise and fall with collections. Use a full-year total.
  • Associates on W-2 add salary and any bonus. If the firm offers a plan, look at that first.

Working with Paul

Coverage help for
people who practice law.

Paul Daniels runs Daniels Health Advisors, an independent brokerage licensed in 30+ U.S. states. Solo attorneys, small-firm partners, and associates without a firm plan call us between hearings. Marketplace plans with possible tax credits are usually where we start. After a strong collections year, we can also walk through private PPO options, including self-employed nationwide PPO coverage. Some private plans ask health questions, and approval is not guaranteed. Some may not cover care for health problems you had before you enrolled.

The Florida Bar offers member benefit programs that can include health-plan options for members and, in some cases, their staff. We do not represent The Florida Bar or those programs. We compare personal and family plans so you can weigh any member option side by side.

Before your next matter

Clear options
beside any Bar program.

A large contingency fee that lands late in the year can push income above your guess, and part of a tax credit can come due at filing. Under current law, starting with 2026 taxes, there is no cap on that payback. We also confirm your doctors are in network. You will finish with:

  • An income estimate built from fees, draws, or salary
  • Office and staff costs set apart for your tax pro
  • A side-by-side look at any Florida Bar member option you bring us
  • Doctors and clinics near your practice checked by network

A checklist for

Attorneys leaving a firm plan.

  • Ask HR the exact date your firm plan ends, then plan your sign-up window.
  • Keep a simple ledger of fees collected by month, not just billed.
  • If you hire staff later, ask a benefits broker whether a small-group plan fits.
  • Need life coverage for a partner or key person? See our life insurance guides too.

Attorney questions

Attorney health insurance FAQ.

I am a solo with a Florida Bar membership. Do I need a Bar plan?

Not necessarily. Member programs exist, but they are one option among others. Compare any member offer with a personal Marketplace or private plan before you join for coverage alone.

My small firm has two associates on W-2. Can we buy a group plan?

Often yes, once you have at least one eligible employee who is not an owner or an owner's spouse. Rules vary by carrier and state. We can help you see personal options while you sort the group path with a benefits broker if needed.

I left Big Law mid-year. What happens to my coverage?

Losing a job-based plan can open a special enrollment period. Ask HR the exact end date, then call us so you are not left without coverage between firms.

Does The Florida Bar require me to use its member health options?

No. Membership programs are optional benefits. Compare them with personal and family plans before you decide.

Can I write off my health insurance?

Maybe. If you are self-employed and your business makes a profit, your premiums may be deductible on IRS Form 7206. You can't take it for any month you could get a subsidized job plan, including through a spouse. Ask your tax pro.

Do I have to wait for open enrollment?

For a private plan (not from the Marketplace), you can often apply any time of year. Some private plans ask health questions, and approval is not guaranteed. Some may not cover care for health problems you had before you enrolled. Marketplace plans, and other plans that follow ACA rules, work differently. As of October 14, 2026, under current law, open enrollment for 2027 Marketplace coverage runs from November 1, 2026, through January 15, 2027. A court case about these dates is still on appeal, so check HealthCare.gov. To start coverage January 1, pick a plan by December 15 (the deadline under current law). Outside those dates, you may need a qualifying life event, like losing job-based coverage, or another special enrollment period.
